This Policy applies to all services offered by MKController through its platform, including network control and associated services. It also applies to data processed on behalf of our Clients (data controllers) and their End Users.


Who We Are

MKController is a Brazilian company specialized in network management and control solutions. We act exclusively as a data processor, as defined under the LGPD (Brazil) and GDPR (European Union). We process personal data solely on behalf of and according to the instructions of our Clients, who are the data controllers.


What Data We Collect

From MKController Clients (Controllers):

  • Name, email address, phone number, and contact information.
  • Login credentials and account activity logs.
  • Technical data such as IP addresses, device configurations, and performance logs.

From End Users of Clients:

  • Data collected by Clients directly, such as names, email addresses, device identifiers, and usage preferences.
  • Aggregated or anonymized data related to Wi-Fi access, such as session duration, signal strength, approximate location, and browsing behavior.

Purpose of Data Processing

Data is collected and processed strictly for the following purposes:

  • Provision, maintenance, and technical support of the MKController platform.
  • Monitoring system performance and enhancing platform functionality.
  • Fulfilling contractual obligations and complying with legal or regulatory requirements.

Relationship with Clients and End Users

Clients as Controllers: Clients determine the legal basis for data collection and are responsible for:

  • Informing End Users and obtaining all necessary consents.
  • Configuring data collection parameters in compliance with data protection laws.

MKController as Processor: We follow our Clients’ instructions and do not use or access personal data beyond what is necessary to provide our services.


Data Sharing

MKController does not sell or rent personal data. Data may be shared only under the following circumstances:

  • With Clients: Data is made available to the data controller who initiated the processing.
  • With Subprocessors: We use vetted service providers for infrastructure, hosting, and technical support. All subprocessors are contractually obligated to meet equivalent levels of data protection.
  • Legal Compliance: We may disclose data in response to valid legal requests, court orders, or government regulations.

Data Security and Retention

We apply industry-standard security practices to safeguard personal data, including:

  • Encryption of data at rest and in transit.
  • Access controls, multi-factor authentication, and audit logs.

Retention periods are defined by the Client (Controller). Where applicable, we delete or anonymize data in accordance with contractual terms or upon the Client’s request.

For Clients: Clients may access, update, or delete their personal data through the MKController platform or by contacting our support team.

For End Users: MKController does not control data collected by Clients. End Users should contact the relevant Client (controller) to exercise their rights under LGPD, GDPR, or other applicable laws.


International Data Transfers

When data is transferred internationally, MKController ensures that:

  • Transfers comply with applicable data protection laws.
  • Standard Contractual Clauses (SCCs), contractual safeguards, or other lawful mechanisms are implemented.
  • Data is hosted in secure environments by trusted infrastructure providers.

We may update this Privacy Policy periodically to reflect changes in legal obligations, technology, or our services. Clients will be notified of material changes via email and/or platform notices. The updated Policy will take effect upon publication.
